AMENDING THE MEASUREMENT CRITERIA FOR LATE NIGHT CONDITIONAL USE PERMITS FOR RESTAURANTS

AN ORDINANCE AMENDING THE SEABROOK CITY CODE, COMPREHENSIVE ZONING ORDINANCE, BY AMENDING SUBSECTION 4.11.14 (C), "ADDITIONAL REGULATIONS FOR ON-PREMISE CONSUMPTION OF ALCOHOL—MEASUREMENT" OF ARTICLE 4, "SPECIAL USE REGULATIONS," TO CHANGE THE METHOD OF MEASURING THE DISTANCE OF A RESTAURANT REQUESTING A CONDITIONAL USE PERMIT TO SERVE ALCOHOL FROM 12:00 MIDNIGHT TO 2:00 A.M.; PROVIDING A PENALTY IN AN AMOUNT OF NOT MORE THAN $2,000.00 FOR VIOLATION OF ANY OF THE PROVISIONS HEREOF BY INCLUSION INTO THE CODE; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES INCONSISTENT OR IN CONFLICT HEREWITH; AND PROVIDING FOR SEVERABILITY.
